Terms of Service For Commissions

(Effective August 2025 – Applies to All Commissioned Work)

These Terms of Service ensure we’re on the same page and help make the commission process smooth, joyful, and respectful for both of us. By commissioning me, you agree to the following:

A 50% non-refundable deposit is required to secure your booking.
This deposit is non-refundable under any circumstances once paid, as it covers my time holding your spot and developing your concept.
Work is considered to have begun once I start concept development, sketching, or gathering references.

2. Payment & Delivery

The remaining 50% balance is due before the final artwork begins.
Final high-resolution digital files will not be delivered, and shipment of original artwork will not be sent, until payment is received in full.
If final payment is not received within 14 days of the client’s approval of the final revision, the commission will be considered cancelled, all rights to the artwork will remain with me, and the deposit will be forfeited.
All prices include standard U.S. shipping unless stated otherwise. International shipping will be quoted separately.

3. Usage Rights

All commissioned artwork is for personal use only.
Personal use includes displaying it in your home, gifting it, or sharing photos online with credit given to “Jessica Bobonis Illustration”.
Personal use does not include use in any business, monetized content, promotional material, or as part of a product for sale — even if the artwork is not directly sold — without my written permission.
I retain full copyright and reproduction rights to the artwork unless otherwise agreed in writing. This is not a “work-for-hire” agreement.
Commercial licenses are available by separate contract and pricing — please contact me directly for details.

4. Artistic Rights

I may use the commissioned artwork in my portfolio, on my website, on social media, and in print products (such as art books or prints) unless you purchase an exclusivity upgrade.
If you prefer your commission not be shared publicly, please request this at the time of booking.

5. Revisions

Full illustrations include up to 2 rounds of revisions at the sketch stage.
Portraits and pet portraits include up to 2 rounds of revisions at the sketch stage.
Mini originals include 1 round of sketch revisions.
Additional revisions beyond these limits will be charged at $25–$50 per round, depending on complexity.

6. Cancellations & Refunds

Deposits are non-refundable.
If I must cancel your commission for any reason, you will receive a full refund of all payments made.
If you cancel after work has begun, you forfeit the deposit but will not owe the remaining balance.
No refunds are given once final artwork is approved and final payment is made.

8. Force Majeure (Unexpected Events)

I am not liable for delays or inability to complete the commission due to events beyond my control (such as illness, accidents, postal delays, or natural disasters).
In such cases, I will communicate promptly to agree on a revised timeline or resolution.

9. Agreement

By commissioning me, you acknowledge that you have read, understood, and agreed to these Terms of Service.
